Workers’ Comp News Alert: 2018 New Jersey WC Rate Schedule Announced

The New Jersey Department of Labor and Workforce Development has released the 2018 Schedule of Disabilities, which is calculated using the statewide average weekly wage (SAWW) of $1,203.43. The amount of temporary disability benefits is subject to a maximum of 75% of the SAWW, or $903.00 for the year 2018. The minimum temporary disability benefit rate is 20% of the SAWW, or $241.00 for the year 2018. Under the New Jersey Workers’ Compensation Law, injured workers are entitled to temporary disability benefits equal to 70% of their average weekly earnings.

The injured worker may also be entitled to permanent partial disability benefits, which are capped at 75% of the SAWW or 70% of the average weekly earnings, whichever is less. Permanent partial disability benefits are payable at rates which correspond to the extent of the injured workers’ disability and according to the 2018 Schedule of Disabilities.
