Delia Clark and Zachary Rubinich present Lorman workers’ compensation webinar on November 30

Delia A. Clark and Zachary M. Rubinich presented a webinar for Lorman Education Services titled “Workers’ Compensation and Psychological Injuries: The Law and Strategies for Defense” on November 30, 2016. Delia and Zach provided attendees with guidance for proper claims handling and defense litigation strategy for psychological injuries which occur in the workplace. The presentation included an in-depth discussion on numerous legal topics, including: what psychological injuries can be claimed, how psychological injuries can be connected to workplace accidents, which benefits are available in psychological injury cases, and the roles and responsibilities of claims adjusters, risk managers, nurse case managers, employer representatives and attorneys.

The program explained the various complex evidentiary issues which can arise during the litigation of mental stress claims. In addition, Delia and Zach provided guidance on evaluation and settlement negotiations to resolve a psychological injury claim. Finally, they analyzed several fact patterns and case studies and discussed the burdens of proof for physical/mental and mental/mental work injury claims. This legal education program provided attendees with practical guidance, tactics and tips that they could apply to their daily businesses in an effort to prevent problematic psychological injuries from arising and showed them how to aggressively manage these claims during litigation and settlement negotiations in the most cost-effective manner possible.

Delia A. Clark is a partner in the New Jersey and Delaware offices of Rawle & Henderson LLP.  She graduated from the Widener University School of Law in 1988 and received her undergraduate degree from Ohio State University in 1984. She focuses her practice on the defense of trucking companies and their insurers, casualty, premises liability, and workers' compensation matters. She is admitted to practice in Delaware, New Jersey, Pennsylvania and the District of Columbia, as well as the U.S. District Courts for the Eastern and Middle Districts of Pennsylvania, the District of New Jersey, the District of Delaware, the District of Columbia, and the U. Zachary M. Rubinich is a partner in the Philadelphia office of Rawle & Henderson LLP. He focuses his practice on the defense of insurance carriers, self-insured entities and third-party administrators against workers’ compensation claims in Pennsylvania. Based on his extensive experience, the Pennsylvania Bar Association Workers’ Compensation Law Section has certified him as Specialist in the practice of workers’ compensation law. Zach has handled all aspects of litigation before workers’ compensation judges, the Workers’ Compensation Appeal Board, the Commonwealth Court and the Pennsylvania Supreme Court.  He routinely counsels employers, insurance carriers and third party administrators on claims management, workplace safety, return-to-work programs, employment practices and risk management. Mr. Rubinich was recently appointed as a Vice-Chair for the American Bar Association’s Tort Trial and Insurance Practice (TIPS) Workers’ Compensation and Employers’ Liability Law Committee for 2016-2017. This is the second one-year term that Zach has served in this position. Zach is rated AV Preeminent by Martindale-Hubbell. He has been selected as a Pennsylvania Rising Star by Super Lawyers from 2010 to 2014.  Rising Stars are the top 2.5 percent of attorneys in Pennsylvania who are 40 years old and younger or have been in practice for 10 years or less.
