RAWLE & HENDERSON provides services to trustees, receivers, creditors, committees, asset purchasers, lenders, lessors, licensors and shareholders in bankruptcy and other insolvency proceedings, such as Chapter 11 and Chapter 7 federal bankruptcy cases and state court receiverships. The Firm has provided guidance and counsel to business, institutional and individual clients in reorganizing and resolving their own financial affairs and difficulties as well as dealing with those of their clients and customers.
The Firm has experience dealing with all aspects of financial disputes and difficulties, both in and out of court. As a result, the Firm is able to assist clients in matters from the earliest stages of economic challenge. We analyze the financial problems of businesses and devise plans to resolve the problems between companies and their creditors.
RAWLE & HENDERSON’s insolvency practice is regional. We have played significant roles in major cases in Delaware, Pennsylvania and New Jersey. We work regularly with clients through all phases of the reorganization or liquidation of troubled businesses. Examples of industry sectors in which we have assisted clients in insolvency matters include: transportation, industrial and manufacturing, communications, financial, international trade, retail, media, technology, energy, and real estate.
The Firm assists creditors in all aspects of the negotiation, restructuring, enforcement, collection and liquidation of all types of loans and claims. Our practice includes enforcement of creditors' rights and defense and prosecution of preference, fraudulent transfer, lender liability, discharge, environmental, and director fiduciary duty claims as well as stay litigation concerning foreclosure proceedings and foreign and domestic litigation or arbitration matters.
Our representations in insolvency cases include assisting clients with transactions in the insolvency arena including claims trading and asset acquisitions in bankruptcy. We also assist clients in structuring their relationships with customers and trade partners to prevent or minimize losses due to insolvency.
